Regulated within the EU since 1996, the status of posted worker allows companies established outside France (EU or third countries) to temporarily post their employees to France or any other EU country.

These companies must nevertheless comply with several conditions and compulsory formalities, and apply to these employees the provisions of the host country's labour law (in this case the French labour code for a posting in our country).

This is naturally accompanied by a battery of rights and procedures that should be analysed together according to your needs and your company profile.

Diagnosis of your intra-group secondment policy (ICT) and/or international service provision secondment policy

Through this service we offer you a complete review of the possible schemes to meet your secondment needs. To guide you in your choice, you will be able to rely on our complete analysis of the advantages, disadvantages and potential risks (working conditions - immigration - social protection). This written assessment will be accompanied by a one-hour oral presentation.
 

"Full compliance" methodology:

Through this service we propose to take charge of the drafting of all the documents necessary for the operational implementation of the chosen secondment option (service provision - intra Group - own account) in terms of working methods/immigration/social protection. We ensure the proofreading and review of the documents already in place to update them with the aim of building a "mobility compliance" policy

Directive 2018 "posted workers": Determination of the amount of the minimum remuneration - Core set of rules - determination of the remuneration elements (salaries/salary accessories):

Through this service we assist you in determining the minimum remuneration threshold that the employer must respect in the context of the payment of the seconded employee with regard to the European regulation of 2018 transposed in France in 2020 and to be indicated in the SIPSI declaration.

Directive 2018 - Verification and/or determination of the applicable extended Collective Agreement (CBA) - classification of the salary grid (grade, coefficient, group)

This service includes the search for the Collective Agreement applicable to employees posted to France, which will make it possible to determine the minimum remuneration to be applied to them according to their grade, group, coefficient, seniority, etc.

Process mapping

Through this service we offer you a mapping of the actions to be taken in order to carry out your international mobility HR operations in full compliance (in the form of a drawn guide/process) for each stage

Immigration and social protection formalities for the seconded employee

Visas, residence permits, French social security registration, obtaining the A1 certificate... 
Through this service, we offer to take care of the immigration and social protection formalities for your employees on secondment to France (Intragroup ICT, International Service Providers PSI): visas, residence permits, registration with the French social security system or obtaining A1 secondment certificates in the context of the application of bilateral social security agreements signed by France. 

SIPSI: Employment formalities - Filing of the Prior to Work Notification (PWN) on the SIPSI website (for 1 employee / or multiple employees):

Through this service we take care of the filing of the Preliminary Declaration of Secondment (DPD) on the SIPSI website for 1 or more employees. This service includes the creation of a dedicated account on the Ministry's website and a verification of the main compliance points necessary for the filing of this declaration. 

Labour formalities: Representative of the foreign company (SIPSI declaration - liaison officer)

Through a series of options, we offer you to become the company's representative for the legal obligations related to the posting in the SIPSI declaration. Whether you keep the SIPSI declaration in your own hands or entrust it to us, we take on the role of "liaison agent" with the French authorities in the event of an inspection (understanding and translating the inspector's requests in the context of his inspection). This service does not include the "assistance" option, and is limited to a coordination role with the administrations.

The "assistance" service, which is optional, is nevertheless proposed to you: in this case, we ensure a thorough compliance check with regard to the documents transmitted by the company and assist you during the inspection at no extra cost, this total assistance being included in our fee.

Administrative support in case of control (labour inspectorate)

Through this service, we offer to guide you during possible controls by the French authorities (help in understanding the letters received as well as the possible response to provide). This service also includes a risk assessment.

Risk assessment

Through this service we offer you a complete review of the possible risks to meet your secondment needs. To guide you in your choice, you will be able to rely on our complete analysis of the potential risks (working conditions - immigration - social protection / financial, criminal risks, etc.). This written assessment will be accompanied by a one-hour oral presentation.
 

Posted Workers training for teams (international mobility / HR / legal / purchasing...)

Through this service we offer training for all professionals (employees, staff representatives, HR managers, international mobility...) in formats adapted to your company (face-to-face or online training / from half a day to 2 days - French / English).

Administrative assistance package / oral information / questions and answers:

Through this package, you receive a precise and adapted oral response to a particular administrative issue that concerns you.

Registration of the foreign company with the SFE (Service Firmes étrangères - ex-CNFE) of the URSSAF (obtaining SIREN)

Through this service we take care of the registration formality of the foreign company with the URSSAF's Foreign Firms Department in order to obtain the SIREN number.
 

Declaration of the seconded employee's work accident to the Labour Inspector

Through this service we offer to take care of the compulsory formality of the Declaration of the Work Accident of the seconded employee to the Labour Inspectorate.
