Posting of Workers in France

Regulated within the EU since 1996, the status of posted workers allows companies established outside France (EU or third countries located companies) to temporarily post their employees to France or to any other EU country. However, these companies must comply with several conditions and mandatory formalities and apply the provisions of the host country's labour law. This naturally comes with a battery of rights and procedures that should be analysed together according to your needs and your company profile.

Le télétravail occasionnel ou régulier est-il sur le point de supplanter l’organisation traditionnelle du travail et de son management ? En tout cas il la bouscule sérieusement. 

Si la législation française accorde aux entreprises une marge de manœuvre au regard de la possibilité (postes éligibles, catégorie de salariés) ou de l’opportunité de le mettre en œuvre, il ne s’agit pas pour autant d’un « droit » opposable et automatique octroyé au salarié, le refus de l’employeur a une demande du salarié de télétravailler étant possible mais devant être motivée.
